Why Midland Families Call Braker White

Braker White is a West Texas firm, and we handle truck cases throughout the Permian Basin from our Odessa office at 230 W 3rd St. We know the haul routes, the oilfield companies, and the way trucking insurers work in this region. Many truck crashes here involve oilfield operations, so injured workers and drivers often need an oilfield accident lawyer who understands both sides of the case.

What you can expect:

  • Attorneys Robert White and Greta Braker, both born and raised in Texas
  • Past results including $4,500,000 and $1,003,554 in truck accident cases and $1,129,236 in an auto accident case
  • A firm with 235+ Google reviews at a 4.6 rating
  • A 100% Free Consultation and No Costly Upfront Fees

We are aggressive with trucking insurers because they work hard to close claims early and cheaply. Past results do not predict future outcomes, and every case depends on its facts.

Why Is a Truck Accident Claim Different From a Car Accident Claim?

A truck accident claim is different because trucking companies must follow federal and Texas safety rules, more than one company is usually responsible, and the most important evidence sits in company files that can legally be discarded within months.

Insurance coverage is also typically much larger, which means the defense is usually better funded.

In practice, that difference shows up in a few ways:

  • Safety rules on driving hours, driver qualifications, and maintenance create a written standard the company can be measured against
  • The driver, the motor carrier, the company that ordered the load, and others may all share fault
  • Engine data, electronic logs, and dispatch records can prove speed, timing, and fatigue
  • Trucking insurers can send investigators to the scene quickly

Those differences are why truck cases need a different investigation than a two-car fender bender.

Where and When Do Midland Truck Wrecks Happen?

Midland's truck traffic is shaped by the oilfield, and so is its wreck pattern. Heavy trucks share I-20 and Loop 250 with commuters, while oilfield haul routes such as SH-158 and FM-1788 carry crude haulers, water trucks, and sand trucks between leases and terminals.

Shift Changes and Tight Haul Schedules

Congestion often spikes when field crews change shifts and trucks run to make the next load. Rushed schedules, long waits at loading sites, and dark rural stretches all raise the risk of fatigue, speeding, and unsafe passing on Midland County roads.

Lease entrances add another hazard, because loaded trucks pull onto fast highways from caliche roads with little warning. At night, a slow or turning truck on an unlit county road can be hard for other drivers to see until it is too late.

Types of Trucks Behind Midland Wrecks

Not every commercial truck on a Midland road is the same, and the type of truck often shapes who is responsible and which rules apply.

Tanker Trucks

Crude oil and fuel tankers carry liquid that can shift and push the truck through curves and stops, especially when partly loaded. Tanker cases often look at driver training, speed for the load, and whether the carrier followed the rules for hazardous cargo.

Sand Haulers

Frac sand haulers run heavy and often on tight delivery windows to keep completion crews working.

Investigations may examine overweight loads, worn brakes, delivery pressure, and whether an operator or completion company exercised enough control over the work to share responsibility.

Water Trucks

Water trucks move fresh and produced water between leases, pits, and disposal sites, often on caliche and county roads. Many are run by smaller carriers, so driver qualification files and maintenance records frequently become the center of the case.

Flatbeds and Equipment Haulers

Flatbeds carry pipe, tubing, and oilfield equipment that must be secured under federal cargo securement rules. When a load shifts or falls, the carrier, the driver, and the company that loaded the truck can all be at fault.

Oversize loads may also need state permits and escorts, and skipping those steps can be evidence of negligence.

Who Can Be Liable for a Midland 18-Wheeler Crash?

Liability for a Midland 18-wheeler crash often reaches several companies, and each may carry its own insurance. The table below shows the most common defendants.

PartyWhy They May Be Responsible
Truck driverSpeeding, distraction, fatigue, impairment, or unsafe maneuvers
Motor carrierNegligent hiring, training, supervision, or maintenance, and responsibility for its driver's conduct on the job
Operator or shipperSetting unsafe schedules, loading practices, or site conditions
Freight brokerNegligently selecting an unsafe carrier
Maintenance contractorFaulty brake, tire, or lighting work
ManufacturerDefective brakes, tires, steering, or other parts

In 2026, the U.S. Supreme Court held in Montgomery v. Caribe Transport II that the Federal Aviation Administration Authorization Act does not preempt negligent-hiring claims against freight brokers when those claims fall within the law’s motor-vehicle safety exception.

The Court did not decide whether the same analysis applies to purely intrastate transportation.

Why More Defendants Can Mean More Coverage

Each company in the chain may carry its own liability policy. When injuries are severe, identifying every responsible company can reveal additional insurance coverage that may be available for the claim.

Federal and Texas Trucking Rules That Prove Negligence

Trucking safety rules establish duties that may become important evidence in a negligence case, including rules on driving hours, driver qualifications, inspection, and maintenance. Which rules apply depends on whether the truck was operating interstate or only within Texas.

Hours of Service

For interstate drivers, the Federal Motor Carrier Safety Administration (FMCSA) hours-of-service rules generally allow 11 hours of driving after 10 consecutive hours off duty, within a 14-hour window, with a 30-minute break after 8 hours of driving.

Texas intrastate drivers may drive 12 hours after 8 hours off duty and may not drive after 15 hours on duty, according to the Texas Department of Public Safety (DPS) motor carrier guide.

Certain Texas intrastate drivers operating commercial vehicles used exclusively to transport oilfield equipment or service oil and gas field operations may restart their seven-day period after 24 consecutive hours off duty instead of the usual 34 hours.

Logs are only as honest as the driver keeping them. We compare electronic logs against fuel receipts, gate and pad sign-in records, dispatch messages, and phone data to see whether the hours on paper match the hours on the road.

Driver Qualification and Maintenance Rules

Motor carriers must keep a driver qualification file for each driver and maintain their trucks under federal inspection and repair rules. A poor driving record, an expired medical certificate, or ignored vehicle defects can support a claim that the carrier failed to meet its safety responsibilities.

Why Must Black Box Data and Driver Files Be Preserved Now?

Much of the evidence in a truck case is only required to be kept for months, and engine data can be overwritten as the truck keeps running. A preservation letter sent early puts the carrier on notice to hold onto what it has.

Federal record-keeping rules set these minimum retention periods:

RecordMinimum Retention Period
Driver logs and supporting documents6 months
Driver vehicle inspection reports3 months
Maintenance and repair records1 year, plus 6 months after the truck leaves the carrier's control
Driver qualification fileLength of employment plus 3 years

Engine control module data, dash cam video, and dispatch messages often matter just as much, and some of that data can be overwritten even sooner if no one asks for it.

Fault, Deadlines, and Where Midland Cases Are Filed

Texas lets an injured person recover as long as they are not more than 50% responsible, and most injury lawsuits must be filed within two years. Serious Midland County injury cases are often filed in the local district courts.

How Shared Fault Affects Your Recovery

Trucking insurers often argue the other driver cut off the truck or braked suddenly. Under Texas proportionate responsibility law, if a jury values a claim at $600,000 and assigns the injured driver 10%, the recovery becomes $540,000. A finding above 50% bars recovery.

The Two-Year Deadline

Most Texas personal injury lawsuits must be filed within two years of the injury, and a death claim generally must be filed within two years of the date of death. Exceptions exist, but the evidence clock runs much faster than the legal one, which is why speaking with a personal injury lawyer early can make a real difference.

Midland County Courts

A lawsuit over a Midland County wreck is often filed in the county where most of the events happened, which means one of Midland County's five district courts, based at the county courthouse on North Loraine Street.

Treatment records from Midland Memorial Hospital or wherever you were treated become part of that case.

FAQs for Midland Truck Accident Attorneys

What if the truck driver was an independent contractor?

Calling a driver an independent contractor does not automatically eliminate potential liability. Depending on the facts, a motor carrier or another company may still face liability based on its own negligence, its relationship with the driver, or other applicable trucking-law principles.

Can I sue if cargo fell off a truck and caused my wreck in Midland?

Yes, a Texas driver hurt by falling or spilled cargo can often bring a claim against the carrier and driver, and sometimes against the company that loaded the truck. Federal cargo securement rules set the standard for how loads must be tied down.

What if the trucking company is based in another state?

An out-of-state trucking company can generally be sued in Texas over a crash that happened in Texas. Interstate carriers also must follow federal safety rules, which can help prove what went wrong.

Should I accept the trucking insurer's first offer?

Many injured people in Texas wait to accept any offer until they know the full cost of their injuries. Accepting an offer usually requires signing a release that ends the claim, even if more medical treatment is needed later.

Does the trucking company's insurance pay my medical bills right away?

Usually not. A Texas trucking company's liability insurer typically pays when the claim is resolved, so injured people often rely on their own personal injury protection (PIP) coverage, health insurance, or other benefits in the meantime.

Can I get the truck's black box data myself?

Usually not. The truck’s owner or carrier typically controls access to engine and logging data, and retrieving it may require specialized equipment, a preservation demand, discovery, or a court order. A Texas truck accident lawyer can demand that the carrier preserve the data before it is overwritten.
